By Odalis Encarnacion So youre toying with the idea of getting married? Maybe somebody has mentioned a Prenuptial Agreement (Prenupt) or maybe youve never thought of it before. Regardless, just as youre an educated consumer you might also want to take a look at the advantages of having a prenuptual agreement before leaping into marriage. The truth of the matter is that asking your fiancee to sign a Prenupt is not the most romantic thing you will ever do. Below are a few tips on planning a marriage with all the love you have for that other person. Understand what it is and what it is not. Some couples forgo the Prenupt conversation for fear that their partner may suspect that they have reservations about the solidness of their relationship. The best thing about a Prenupt is that is does exactly what is suppose to do, it either breaks you up before you commit financial suicide or it makes your relationship even stronger. Ironically, and contrary to long held common belief, according to family surveys, men and women sign Prenupts at an evenly low 16% rate across the table. Increditably, women have a higher percentage of initiating a Prenupt agreement than men. Know who it applies to. Whatever the gender, a Prenupt is especially vital to young adults starting out in their respective careers. In New York a spouse may be entitled to a significant percentage of the value of a professional license earned during the marriage or a master degree earned during the marriage. Basically, if your spouse supported you–even by giving you gas money, for example–during your days as a law school, medical school or business school student, then come divorce time you essentially may be working your entire life for your former spouse. Why? The reason for this is simple but the emotions are a lot more complicated. Because the math formula used to calculate the value of the license contemplates the value amount you will make during your entire working life, the law says that your spouse can possibly collect money decades after the divorce. Its true: the average couples who walk down the aisle dont want to think about potential future financial disagreements. In fact, they dont even consider the future need of having to deal with a divorce and all of its headaches. Regardless of your confidence in the relationship though, the US national divorce statistics give a more realistic, sobering view of marriage and its potential disadvantages. Take a look at the statistics and be honest with yourself. According to the United States Census Bureau, more than fifty percent (50%) of all marriages end in divorce. In 2002 there were 136,684 marriages in New York, and in that same year there were 65,428 divorces. New York is in part with the rest of the country where the divorce rate is at 52 percent. Those numbers are especially hard to accept if you were a couple contemplating any kind of legal union. Understand a Prenupts true importance. So how important is a Prenupt in light of these awful statistics? Imagine having to choose between keeping the familys business or having your former spouse for a business partner! Whos it for? Some people may suggest that a Prenupt is only for those wealthy forks. This could not be any further from the truth a Prenupt is for everyone. I always advise my clients to consider a Prenupt whenever they are considering marriage. A Prenupt is as essential to a marriage as a wedding ring nobody should get married without one. Why is it important? The average working class couple owning no property or significant assets should also sign a Prenupt, because chances are they will inherit property or other during their marriage. This could be you. For example, remember the classic example illustrated by Colombian-born Juan Rodrguez, who was the sole winner of the New Yorks lottery multi-million dollar jackpot? Rodrguez, had arrived in the United States in 1982 and worked as a parking lot attendant for most of his life. Even though he had been separated from his wife, he never tried to divorce her for lack of money. Mr. Rodriguez did not have a Prenupt. His estranged wife who was living apart from him at that time, received nearly half of his winnings in a divorce that was filed days after he won the lottery. Had a prenuptial agreement been in place, she never would have gotten a cent. Save yourself the headaches. Its unfortunate that couples sometimes overlook this very important agreement before they commit to a lifetime financial partnership. A Prenuptial agreement is very much like a road map: it guides you along the ride of marriage. Think about it this way: just like going on a long cross-country trip, requires a good map to guide you, so to does marriage require a Prenupt agreement. Most people find they need something to help them understand as much as possible the intentions and goals and emotional needs of the other person BEFORE they commit their life in marriage. After all, eating food is what makes us big so reducing our portions must therefore mean reducing our waist line. By Bev McClune A Whole Cloth Quilt uses one large piece of fabric for the quilt top, instead of an arrangement of patchwork or appliqud blocks. The beauty of these quilts comes from the elaborate, quilted patterns that feature on the quilt top. In a Whole Cloth Quilt, the stitching is the highlight of the quilt. It adds designs through the clever manipulation of the thread to create light and shadow, texture, and dimension. In the past these quilts were made by cultured ladies of wealth and leisure. They used their fine sewing skills and abundant free time to decorate solid coloured material with floral motifs, feathered and geometric shapes. Even with a sewing machine, many modern quilters feel intimidated by the thought of a huge blank piece of fabric. For those that truly love quilting it is an opportunity to be creative. The quilter marks the design on the fabric using various marking tools and marking techniques. The quilting stitches should be small and even, to create visually strong outlined shapes where light and shadow will play. The stitching of white threads on white fabric is also known as White Work. In the late 18th century an all white wedding quilt traditionally graced the bed of the newlyweds in the Provence area of France. These “courtepointe de marriage” were decorated with lavishly stitched symbols of love, fertility and prosperity. These all white quilts also featured extravagant stuffed work and cording which the French called “boutis”. The technique of stuffing the outlined shapes with extra wadding, to make them puff up, originated in Sicily. This “stuffed work” is called Trapunto. Stuffing the motifs gives a greater sense of depth, creating an elegant sculptured affect with the fabric. In by gone days, this arduous task was accomplished by slitting a tiny hole in the back of the quilt and pushing through small bits of filling. There is no need to be put off as creating these beautiful quilts is less complicated in this era. Today’s innovations like water-soluble thread, wash out markers, and quilt and tear paper, along with techniques such as “Quilt As You Go”, have simplified the creation of Whole Cloth Quilts and the skill of Trapunto. How To Test Body Fat

By Gen Mason When it comes to measuring your body fat percentages, there are many ways suggested to go about this; however, not all of them are reliable in that they take all of the different compositional elements into account. For example, the oldest way of measuring body fat percentage is known as the BMI, or the Body Mass Index. This is based on the individual’s height and an average weight for the same but that is not a reliable way of measuring the initial or the changing composition of an individual’s body. There are two components to body mass in general; fat mass and lean body mass. However, to consider this issue, the lean body mass can also be further divided into three other categories; bone, muscle, and what is commonly known as ‘everything else.’ Considering that all of these different components contribute to the overall body mass, the BMI does not consider how the mass is broken up. Thus bone is equal to muscle, which is equal to everything else; and this does not portray an accurate picture on how much mass is actually body fat. Another problem with the BMI is that because it does not break the body mass down into the independent categories when one is participating in physical training, the decline in body fat can often be replaced by an increase in muscle mass yet there is no distinction between the two using the BMI. So what’s next? Now-a-days, a common way to measure body fat percentages is through the use of the “Gold Standard Test.” What is this? Well, it is not a test you can routinely do yourself; rather it is a test that needs to be monitored carefully. You get into a pool of water, expel all of the air from your lungs, and then submerge yourself; the goal being to test for your hydrostatic weight. Often times, it is necessary to repeat this four or five times before an accurate weight can be derived and the results are somewhat questionable. A second option using the same basic premise as the Gold Standard Test available today is a test in which the BOD POD TM is used and measurements are taken on the air displacement released into an enclosed chamber. While the results here are more accurate, the equipment necessary to perform the test is very difficult to attain. And of course, the equipment is quite costly. So the DEXA or more commonly called the DXA was introduced to try and compete with the expense involved with the BOD POD TM. However, this device has very poor results as they vary significantly simply based on who manufactured the equipment. So this is one new measurement you definitely want to stay away from! Perhaps the most beneficial and accurate means of measuring your body fat percentage is found through the use of the BIA technology. BIA stands for Bioelectrical Impedance Analysis. This test passes a small electrical current (which is not painful at all) through the body and then measures the body’s electrical resistance which equals the total body’s water content. The body fat can then be determined through a distinct difference in resistance than the lean body mass has. Thus accurate results are forthcoming in all components of the body individually, instead of lumping them all together as the original testing was prone to do. One does have to be cautious, however, when using this type of body fat analysis as it should not be done any more frequently than once a week. So those who like to test daily after each workout would not be able to use this method that continuously. There is some preparation that one must adhere to before beginning this test to assure accurate results. Firstly, you cannot eat or drink for four hours prior to the testing; secondly, you cannot exercise twelve hours prior to testing; thirdly, there can be no consumption of alcohol for forty-eight hours prior; and there must be no evidence of diuretic use at all. After the testing is complete, measurements from the wrists and the foot are taken and analyzed for body fat, body muscle, and water percentages and the results can be charted for follow-up at a later date when another test may be administered. So for all of you out there trying to figure out the best way to measure your body fat, the days of girth measurement are over! Criminal Law: A Critical Analysis of the Crown Court

By Thomas Gallagher Introduction The Crown Court is part of the Supreme Court of Judicature and deals with the most serious of criminal offences. This article will detail some important facts regarding the Crown Court, examining its origins and exploring the reasons for its introduction. Next will be a detailed account of the procedures involved within the Crown Court, such as who the judge is and what role the judge has regarding the trial. Others areas considered will be how evidence is presented, and sentencing that may be imposed on a person who has been found guilty of an offence. The Crown Court is not only a mechanism for dealing with offenders. It is also a place that can offer closure to concerned victims when justice is administered. For this reason, it is important to discuss the procedures involved for victims. Finally, the article will explore future proposals for the Crown Court, and the criminal justice system as a whole. Origins The Crown Court was created by the 1971 Courts Act which abolished the ineffective system that was in place at the time, which involved numerous local Assize courts throughout the country. This system could not cope with the number of criminal offences. The Assizes were periodic local courts heard before judges of the Queen’s Bench Division of the High Court, who traveled across the seven circuits into which England and Wales were divided, assembling juries in the Assize Towns and hearing cases, and, therefore, a more robust system needed to be introduced. Nevertheless, the Court of Assize was created by Henry II in the 12th century, introducing the first trial by jury. Although it bares little resemblance to the jury system today, it was the first time that guilt or innocence of the accused was not decided by divine intervention, as was the case with trial by ordeal. The system was first piloted in both Liverpool and Manchester in 1956, and was employed nation wide in1972. There are ninety Crown Courts in England and Wales, with the most well known of these being the Old Bailey in London, which sits at the pinnacle of the Crown Court system. The Crown Court provides an environment that enables decisions to be made solely on the evidence provided. Procedure in the Crown Court The time it take for a case to be heard at the Crown Court can be between three and six months. It can, however, in certain case, take even longer. It is not unusual for a defendant to meet their barrister on the first day of their trial. This situation has led to some suggesting that justice maybe being sacrificed for judicial expediency. Any case that is sent from the Magistrates Courts, to the Crown Court, will be presided over by a trial judge. The rank that a trial judge will hold can be determined by the colour of their robes, with more senior judges wearing red robes. The judge will supervise the trial from a raised platform at the front of the court room (known as the bench), and will determine what may, or may not be adduced into evidence. In front of the judge will be his clerk, who will face the usher of the court. The usher is charged for moving evidence around the court and also bringing witness into the court. The procedure for a judge entering a court consists of a statement being made by the clerk all rise followed by everyone in the court standing until the judge is seated. This practice entails a showing of respect by people within the court for the judge. Once the judge is seated, the trail will begin. The prosecution will go first in all cases. This will then allow the judge to assess whether a strong enough case has been presented for the trial to proceed. It is not unusual for the defence not to offer any submissions, as the judge can make the decision that there is no case to answer. If, however, there is a case to answer, then the defence will then offer its submissions to the jury. The advocates for the prosecution must prove, beyond reasonable doubt, that the person charged with the offence, did indeed commit that offence. Once all submissions have been made by both barristers, the jury will then retire to consider its verdict, which translates to speak the truth. They will be asked to return either a guilty, or a not guilty verdict. The ramifications for a defendant who enters a not guilty plea, and is then found guilty by a jury, can be severe. This is so as the judge will examine the consequences of the initial plea. For instance: if a person enters a not guilty plea, and is found guilty, regardless of whether or not he is guilty, the judge will take into consideration the cost of the trial to the taxpayer, the fact that no remorse has been shown by the accused, and wasting the courts time. This can lead to an increased prison sentence. Conversely, an innocent person may decide that even though he has not committed the alleged crime that he is accused of, the evidence as it stands implicates him. He may, therefore wish to enter a guilty plea and ask the court to take into consideration the factors that are mentioned above, albeit in a positive manner. Although this may sound a little strange, it is a consequence of due process, and is in existence throughout most societies throughout the western world. Victims of Crime The Crown Court can offer closure to victims of crime. The equitable maxim that justice must not only be done, but must also be seen to be done, is most apparent in criminal proceedings. Punishment of defendants by way of incarceration can offer victims retribution. Although this can never be enough for an individual who has maybe lost a loved one at the hands of another citizen, the fact that the victim has had their justice, can be enough to enable people to rebuild their lives. There is also a victims charter that was introduced in1996, although this has since been reviewed since the death of Stephen Lawrence to take into account of racist crime. Possibilities for the Future The Crown Court has, like most other institutions within the Criminal Justice System, been subjected to severe scrutiny. The Review of the Criminal Courts of England and Wales has suggested that a new unified criminal court should be formed, whereby the Crown Court would be renamed as the Crown Division, dealing only with indictable offences and serious either-way offences. There is also more radical proposal to replace the present jury system with a bench of three judges. This later proposal, has, however, been met with rejection in some quarters. A trial by jury is seen by some as underpinning the very foundations of a democratic society, something that maybe sacrificed for judicial expediency. Others, however, have suggested that asking a jury to understand complex rules of criminal law can lead to a miscarriage of justice, on either side. Conclusion The purpose of this article is to offer a brief insight into the Crown Court. To understand any system, one must first a certain level of knowledge regarding the origins of that system. What has been shown is that the Crown Court, although it deals with criminal defendants, can offer comfort for victims of crime. It can, however, also be a harrowing experience for anybody, especially those wrongly accused of a crime. What the future will hold for the Crown Court, and indeed all the criminal courts in England and Wales, is uncertain at this moment in time.
